Karl-- I completely agree with you. I think there is a double standard in the IP component of export control as well as in antidumping and CVD's. I also think that there is a lacking sense of urgency on the government's part to educate small business peopls about the value of IP rights to them in general.

With the current mood on the Hill changing, you might see a more small manufacturer job concious approach to IP enforcement as opposed to the big service and corporate identity emphasis that has many irked.

The information in this blog is an excellent breakdown of the laws and regulations concerning the proper procedure of registering with the United States Patent and Trademark Office and their relationship to the Customs officials that enforce them. However, if the U.S. Customs is our “Angel” at the border, than that angel’s halo is held firmly in place by the horns that support it.
Our copyright and trademark laws are being grossly infringed upon to the tune of billions of dollars by Chinese imports alone, not to mention the vastly growing number of imports from the rest of the world. Everything from knock off fashions to music albums to Hollywood blockbusters are being introduced to this country through all of our major ports. These are just three basic examples of the most popular items that can be found on New York’s Canal Street in China Town. Although Customs officials cannot personally check every freight container that comes off a ship, there must be some crackdown on the huge amount of counterfeit goods coming in from all over the world. If the Customs laws that are in place have no teeth or are not enforced at all, companies shipping goods into the country will have no fear dealing in goods protected by Intellect Property rights.
As discussed, the fee is nominal for registering with the Trademark and Patent Office and spells out not only who can use the copyright, but it also creates a record by which agents can regulate the movement of trademarked/copyrighted materials. Careful consideration should be used when registering such trade names to avoid seizure of protected materials and to prevent an enormous loss of revenue due to the importation of counterfeit/pirated goods.
In a Congressional committee meeting by the House Small Business Subcommittee on Tax, Agriculture and Technology on July 20, 2006, Jeb Bradley gave chilling testimony as to the incredible growth of trade with China and the extensive intellectual property violations noted in the seizures of Chinese imports. The statement, “According to the United States Patent and Trademark Office, China is the largest single source of seizures of infringing products by United States Customs-- roughly $62.5 million, or 66% of total goods seized, in fiscal year 2003,” shows the overwhelming percentage of Chinese violations. Despite this high number the United States has only, “threatened to impose $1.5 billion in trade sanctions against China if it failed to strengthen its IPR laws.” Threatening is not the answer, registration of copyrights and trademarks and the enforcement of those registrations are the keys. The committee goes on to say that due to improper enforcement, “IP counterfeiting and piracy in China cost United States copyright firms $2.3 billion in lost sales in 2005.”
The intellectual property rights must be enforced to maintain the efficacy among creators. They should be free of the fear of major loss in revenue due to counterfeiting and lax Customs policies. Exporters should understand the registration process and know that sanctions will be levied if they do not take an active role in limiting pirated materials being produced and shipped. Lastly, Customs officials should truly be our “Angels at the Border,” as they are our last line of defense in the dissemination of these materials.

Hey, thanks for the info! I filed papers for my animation LLC in March, and despite all the research (online) that I did, I read nothing about this new law. It's scary how hard it is to find information about starting a small company without paying an attorney. New York Loves Small Business?? More like New York Loves Lawyers, Accountants, and Obscure Newspapers.

By the way, I was told I need to publish in the Brooklyn Phoenix. I can't find a telephone number for them anywhere on the web. Any ideas??

Thank you for commenting--srry for may late rely, we had somethingof a server disaster recently. I don't see how one could extract enough original content fromn stage directions geared at a specific play to warrant stand alone copyright. So yes I think Einhorn is stuck in derivitive country. And yes, he would be barred from exercising his rights by the underlying copyright holder, the playright. However, the reverse is true as well. To the extent the playright executes the show in a manner that relies on the derivative stage directions, it too would be an infringement, acase of the two serpeants locked together.

Or would they, as Einhorn has made it out to be (in his copyright registration) a derivative work? Because if that is the case, I don't see how his copyright interest would be deemed valid when the playright will surely deny any permission to use the underlying work.

Well first I would like to say... get a cup of coffee or what ever you do to sit these things out. :-)
I did basketball moves for this small production company back in1996. I was on the set of a movie call Fakin the Funk, and they had numerous basketball scenes. There was this big slam dunk contest between me and one of the characters, which was a bet...part of the plot. Well actually it was added in. Nevertheless, we put on a show and even though I really won... I had to lose, this is just where it started.
One of the cast members had a friend who was putting together a opening for the pilot of the Steve Harvey Show. The pitch was that it was for an up and coming comedian that was trying to break into Network Television. I went to this small studio... with other people, and we shot many variations of moves and dunks. I was promised that it would only be used for a one time meeting with the "big wigs" as part of the sales pitch.
About a month later, I received a release form in the mail. I inquired about it and was told that the Network liked the pilot. They really like the opening... especially my part and wanted to use it "as shot". When I asked how much they were giving me to sign off, they said "nothing, but they want you to sign so it can be used". I told them that I would not sign if I would not be paid. The response was well then you would not get to be on TV, and I told them that I had already been on TV before so it is no big deal without money. Also I was going abroad to play basketball anyway so I would not even see it. That was the end of the conversation.
A few years had gone by, and I happened to come across the show, while I was in a hotel room. I made plenty of inquiries, which led me nowhere. I was a member of SAG and after a long while, they told me that I had to contact AFTRA. This takes us to May of 2002, and after 5 inquiries, which led to dead ends... I contacted Shari Harding at SAG and she gave me some names at AFTRA. One of them was William K. After about 3 phone calls he finally called me back. During our conversation, He informed me that I should have been paid for the spot, but I had to talk to Kathy Ewers. It took about a month of leaving messages, then I finally caught her on the phone. She told me that she was just thinking about me and was going to call...yeah right. Anyway, that started an email relationship that lasted for months... months of BS as it turns out. I had tried an attorney that wanted to take the case on contingency. He drafted a letter to AFTRA about his intent to file a case in court (spring of 2003). From then on David Besbris, Director of TV contracts, took over and miraculously started to file a grievance. On the eve of the attorney filing (if he ever was) AFTRA had an arbitration date. The attorney I had no entertainment law experience and was convinced to back off because of the Collective Bargaining Agreement... ha!
He quit the case and left me in the hands of AFTRA... and the day before arbitration, Mr. Besbris cancelled... called me and told me that Universal wanted to settle, so court was no longer necessary. About a week or so later, He sent me the settlement decision for 1600 dollars, saying that he classified me as an Extra and that was what I was entitled to. Can you believe it?? I accused him of all kinds of things and he wanted to meet with me to explain how this came about. Well, I ordered the Code book and read for clarity. When he could not convince me that the book was wrong, he told me that I could get an attorney. Three time he told me this in our meeting... also he said that I had a good case, but my attorney came to him and this is how he settled it. It was not what they could do... but all he would do. See I was never a member, and he was not inclined to do ALL he could.
After a while, I found what I thought was an Ent Atty That would help. He decided to sue AFTRA and Universal :Damages for breach of fiduciary duty and Quantum Meruit, was the title and AFTRA was on the top of the list. To make a long story short… now… The atty did not follow through with filing the proof of service; he never responded to anything the 3 Universal attys filed; he did not write up the complaint correctly so when they attacked it my atty did nothing. And to top it all off… HE DID NOT EVEN GO TO COURT FOR THE MOTION TO DISMISS… on the basis that the union has jurisdiction over the settling of the case, because I was a member, and I was not. He left me completely in the dark as to why the court dismiss (but with leave to remand), and he told me we were shafted by the federal court… but in fact I just found out that He shafted me. It is a little messy, I know, but doesn’t that make it fun… and after the Taster’s Choice lawsuit, we have some momentum.

There is more to discuss and more to know, but only if you want to get them. Do you? I have my files now, copies of the emails and letters between me and AFTRA, also with Mark Higgenbothan at Universal.
